Welcome to My Heritage Record, (“we,” “us,” “our,” or the “Platform”). These Terms of Service (“Terms”) govern your access to and use of MyHeritageRecord.com, and any related services, features, content, or applications (collectively, the “Services”).By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
My Heritage Record, provides a private, user-directed platform that may include:
Account and profile creation.Uploading, storing, organizing, and accessing audio, video, text, and other media (“User Content”).Optional invite-only sharing or access tools.Optional assisted services (e.g., setup guidance, interviews, editing, production) where offered.Optional affiliate, referral, or promotional programs where offered.
Important: We provide a platform and optional services. We are not an executor, trustee, estate administrator, lawyer, therapist, archivist, or custodian for inheritance purposes.
You must be at least 18 years old to use the Services. By using the Services, you represent that you have the legal capacity to enter into this agreement and that you are not prohibited from using the Services under applicable law.
4.1 Account responsibilityYou are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you suspect unauthorized access, contact us promptly.
4.2 AccuracyYou agree to provide accurate and current information and to keep it updated.
4.3 Access recoveryIf you lose access to your account, recovery options may be limited. You acknowledge that account recovery may require identity verification or may be impossible in certain cases.
5.1 OwnershipYou retain ownership of your User Content. We do not claim ownership of your User Content.
5.2 License to operate the Services
You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, display, and perform your User Content solely to provide and operate the Services (including backups, security monitoring, and technical delivery).
5.3 Your responsibilities
You may not use the Services to upload, store, share, or distribute content that:
Violates any law or regulation.Infringes intellectual property, privacy, publicity, or other rights.Contains harassment, hate speech, threats, or abuse.Is defamatory, fraudulent, or misleading.Contains malware, harmful code, or attempts to compromise the Services.Depicts unlawful conduct or encourages wrongdoing.
We may remove content, restrict features, or terminate accounts at our discretion, including to comply with law or protect the Services and other users.
You control who can access your User Content by managing your account settings and by choosing whether and how to share access credentials or invitations.You are responsible for deciding who should have access, how they receive access, and for storing or distributing passwords, access keys, or instructions (including through a will, lawyer, or trusted individual if you choose).We do not monitor or verify relationships, family status, identity claims, or entitlement to access content unless required by law or explicitly agreed in writing for a separate service
My Heritage Record, does not verify death, incapacity, or life status, and does not guarantee any automated “after-death” release, trigger-based delivery, or inheritance workflow.If we later offer optional features related to delayed access or release, those features will be governed by separate terms, may require additional verification, and are not guaranteed to be available in all jurisdictions.
We may offer optional assisted services (e.g., onboarding assistance, guided interviews, editing, production, transcription, page creation, or other deliverables). Availability may vary by location and capacity.
9.1 Scope and deliverablesAssisted services may be governed by a separate scope of work, project outline, or service agreement. If a conflict exists between these Terms and a written service agreement, the service agreement controls for that service.
9.2 User responsibilities
You remain responsible for permissions and consents of any individuals recorded or included. You must review any final deliverables for accuracy before sharing.
9.3 No promises of outcomeWe do not guarantee emotional impact, completeness, or that any deliverable will meet subjective expectations.
10.1 FeesSome Services require subscription or one-time fees. Prices and what is included are displayed at checkout or in your plan details. We may change prices and features at any time, subject to applicable notice requirements.
10.2 BillingSubscriptions renew automatically unless cancelled. You authorize us (and our payment processors) to charge your payment method for recurring charges, taxes, and applicable fees.
10.3 RefundsUnless explicitly stated otherwise in writing, fees are non-refundable. If we choose to issue a refund in a particular case, it does not create an obligation to do so in the future.
10.4 Payment failuresIf payment fails, we may suspend access or downgrade services until payment is resolved. We are not responsible for any loss or consequences arising from payment failure.
The Services are provided “as available.” We do not guarantee uninterrupted access, permanent availability, or that content will be stored for any specific period. We may modify, suspend, or discontinue all or part of the Services at any time.
You may cancel your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Services, other users, or our operations.Upon termination, access to your User Content may be removed. We may retain limited data as required by law, for security, or for legitimate business purposes.
The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.No system is perfectly secure. We use reasonable safeguards but do not guarantee that the Services will be free of unauthorized access, errors, interruptions, or data loss.
To the maximum extent permitted by law, My Heritage Record, will not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of data, emotional distress, reputational harm, or service interruption.Our total liability for any claim arising out of or relating to the Services will not exceed the amounts you paid to us in the 12 months immediately preceding the event giving rise to the claim (or, if greater liability is required by law, the minimum required).
You agree to defend, indemnify, and hold harmless My Heritage Record, from any claims, damages, liabilities, losses, and expenses (including legal fees) arising out of or related to your User Content, your use of the Services, or your violation of these Terms.
We may update these Terms from time to time. The “Last updated” date will change when updates are made. Continued use of the Services after an update constitutes acceptance of the revised Terms.
These Terms are governed by the laws of [JURISDICTION], without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in [JURISDICTION], unless otherwise required by law.
